8. Payment, Refunds & Force Majeure

All payments for services are governed by individual service agreements or proposals sent to the client. Unless otherwise agreed in writing:

  • Payment terms are advance or milestone-based

  • Taxes are applicable as per Indian law

Refunds & Cancellations

  • Once a proposal or Service Level Agreement (SLA) has been mutually agreed upon and program planning or preparatory work has begun, payments made are generally non-refundable.

  • Refunds will not be issued for cancellations initiated by the client after acceptance of the proposal, even if the session has not commenced.

  • However, exceptions may be made at the sole discretion of NIMka Solutions Pvt Ltd, in circumstances deemed extraordinary.

Force Majeure

  • NIMka Solutions Pvt Ltd shall not be liable for any delay or failure to perform its obligations if such delay or failure arises from causes beyond its reasonable control. These include, but are not limited to: acts of God, natural disasters, war, terrorism, civil unrest, labor strikes, government mandates, pandemics, technical failures, or any similar unforeseen events.
    In such cases, both parties will make best efforts to reschedule services or arrive at a mutually acceptable solution.

10. Governing Law

These Terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of courts in Pune, Maharashtra.
